Effective 2026-10-14. Version 2026-10-14.
Terms of Service
Important: section 12 provides for individual binding arbitration, a class-action waiver and a jury-trial waiver, subject to exceptions, mandatory law and a 30-day opt-out. Please read it before agreeing.
These Terms are between Liaison, Inc., operator of Start Booking (“Start Booking,” “we,” “us”), and the person or organization agreeing to them (“you”). “Services” means our scheduling software, hosted booking pages, websites, supported applications and related features. A “Merchant” operates a business using the Services; a “Booking Customer” books or purchases a Merchant’s offerings. “Your Data” means information and content submitted through your account. These Terms apply when presented to and accepted by you on or after their effective date. They do not retroactively substitute parties to an existing contract or replace a historical agreement without valid acceptance. Existing accounts and signups begun under earlier Terms remain subject to those Terms unless a replacement is validly accepted.
1. Agreement and eligibility
You must be at least 18 and have authority to enter this agreement. If you act for an organization, you represent that you may bind it, and “you” includes that organization. An applicable order or separately signed agreement controls over conflicting provisions of these Terms only to the extent of the conflict. Our Privacy Policy describes data practices; it is not consent to optional advertising. Merchant offerings are governed by the Merchant’s own lawful terms, not a promise by Start Booking to supply them.
Nothing here removes consumer protections, statutory cancellation or refund rights, privacy rights, accessibility duties, or other rights and remedies that cannot lawfully be waived. Where local mandatory law conflicts with these Terms, that law controls.
2. Accounts and security
Provide accurate account and billing details and keep them current. Protect credentials, limit staff permissions, and notify support@startbooking.com promptly of suspected compromise. You are responsible for authorized users and activity you authorize or permit through a failure to exercise reasonable care, subject to applicable law. We may request reasonable evidence of account authority and restrict disputed access while investigating, without determining legal ownership of a business.
3. Merchant and customer responsibilities
Merchants, not Start Booking, supply their offerings and are responsible for their quality, safety, licensing, insurance, staff, availability, prices, taxes, fulfillment, cancellations, refunds and disputes with Booking Customers. We provide software, not professional advice, a marketplace guarantee, or an endorsement of a Merchant.
Merchants must maintain lawful customer-facing terms and privacy notices; obtain required permissions for data, calendar access, email, SMS and marketing; honor opt-outs; and comply with applicable privacy, consumer, communications and accessibility laws. Only send messages to permitted recipients. Do not treat access to a booking address as marketing consent. Use appropriate safeguards and provide lawful instructions when we process booking data on your behalf. You may not promise customers rights against us or disclaim our non-waivable obligations.
Booking Customers must provide accurate booking information and use the relevant Merchant’s contact channel for appointment changes, service issues and Merchant refunds. Check confirmations and time zones. Merchants should monitor schedules and integrations, verify critical communications and maintain appropriate independent records and contingency arrangements.
4. Acceptable use
Do not use the Services for unlawful conduct, fraud, harassment, discriminatory unlawful offerings, infringement, unsolicited messages, malware, credential theft, unauthorized surveillance, interference or unauthorized system access. Do not scrape nonpublic information, bypass security or usage limits, resell access without authorization, or reverse engineer software except where the law permits despite this restriction. Authorized interoperability and lawful security research remain subject to applicable law; this provision does not prohibit protected legal activity.
Do not submit payment-card details outside the designated payment interface, third-party passwords, government identification numbers or regulated health information requiring a business associate agreement unless a separate written agreement expressly authorizes that use and required safeguards. Start Booking does not promise HIPAA compliance through these Terms. Observe documented API and plan limits; we may change limits prospectively under section 7.
5. Intellectual property and data
We and our licensors retain rights in the software, branding and documentation. Subject to these Terms and your plan, we grant a limited, nonexclusive, nontransferable right to use the Services during your authorized subscription. No ownership transfers to you.
You retain rights in Your Data. You grant us the limited rights to host, copy, transmit, display and process it as reasonably necessary to deliver, secure, support and maintain the Services and follow lawful instructions. This is not a blanket license to publish private booking records or use them in advertising. You are responsible for necessary rights in uploaded material. We may use genuinely deidentified or aggregated information for service improvement and analysis subject to applicable law, and will not attempt to reidentify data where prohibited. Feedback may be used without compensation, but that does not license private customer data.
6. Subscriptions, payment and cancellation
Your checkout or order identifies the subscription interval, price, trial conditions, included features, additional usage charges, and applicable payment-processing fees. Do not assume a legacy fee schedule applies to your plan. Unless stated otherwise, prices are in US dollars and exclude applicable taxes. You authorize the disclosed recurring charges through the payment method you provide. Subscription periods renew at the disclosed interval until canceled, subject to required renewal disclosures and consent.
You may request subscription cancellation through account billing controls where available or by emailing support@startbooking.com. Cancellation stops future renewals when processed under your applicable order and mandatory law; it does not itself request deletion of booking records. Cancellation may take effect immediately, so do not assume access will continue until the end of a billing period. Your applicable order and non-waivable rights control any remaining paid-access or refund entitlement. These Terms do not change an existing subscriber’s billing schedule.
Except as your order or mandatory law provides, fees for service already supplied are not refundable, and unused time does not automatically create a credit. We honor enforceable prepaid commitments and required refunds. Notify support promptly of suspected billing mistakes; delay does not waive non-waivable dispute rights. We may suspend for unpaid undisputed charges after legally required notice and a reasonable opportunity to resolve payment issues.
7. Changes to prices, Services and these Terms
For any lawful reason, we may introduce, modify, limit, replace or discontinue features, plans, integrations or Services, adjust prices or usage limits, and revise these Terms. Changes are prospective. We will honor binding existing orders and prepaid commitments or provide legally required remedies; a posted change does not retroactively increase an accrued charge, erase an existing claim or reduce a non-waivable protection.
New prices generally apply to new purchases or later renewals as disclosed, not a prepaid current period. We will provide advance notice, cancellation opportunities and affirmative assent wherever required by law or an existing agreement. These Terms do not impose a voluntary fixed 30-day price-change notice in every case, but do not override any such existing commitment or legally required notice.
We will identify the version and effective date of revised Terms and provide material-change notice through appropriate account, website or email channels. Review the current Terms periodically. Continued use after a properly notified effective date signifies acceptance only where legally sufficient; where affirmative acceptance is required, we will obtain it. If you decline, you may stop use and cancel subject to existing commitments and mandatory remedies. Dispute-resolution changes will not apply to disputes already accrued or notified without valid separate agreement.
8. Availability and third parties
We do not guarantee uninterrupted access, error-free scheduling, message delivery, calendar synchronization, data recovery or any particular business result. Maintenance, outages, internet failures, attacks, payment networks, email/SMS providers, hosting, device settings, third-party APIs and calendar changes may delay or prevent functions. There is no uptime or recovery-time commitment unless separately agreed in writing.
Third-party services have their own terms and privacy practices. You authorize data exchanges necessary for integrations you enable and must maintain required permissions. We may restrict or discontinue an integration if a provider changes it, withdraws access or creates a security or legal risk. These provisions do not excuse our own non-waivable duties or remove remedies required by law.
9. Suspension and termination
You may stop using the Services and cancel as described above. We may suspend or terminate access for material breach, unlawful use, nonpayment, security risks, or legal requirements. Where practicable and lawful, we will explain the reason and allow a reasonable opportunity to cure; urgent risk may require immediate action. We may also end a Service or account for another lawful business reason with notice and remedies required by law and binding commitments.
On termination your access license ends. Accrued lawful fees remain payable. Request necessary data before access ends; export availability, retention and deletion are subject to actual capabilities, lawful retention duties and the Privacy Policy. No perpetual storage or instant deletion is promised. Provisions intended to survive, including accrued payment obligations, IP, liability, indemnity and dispute resolution, survive to the extent lawful.
10. Warranties and liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title and noninfringement, and warranties arising from course of dealing or usage. No oral assurance creates an additional warranty.
To the fullest extent permitted by law, Start Booking and its officers, employees and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, lost profits, lost revenue, lost business opportunities, goodwill, or loss of data, even if advised of the possibility. This exclusion does not reclassify a legally recoverable direct loss as indirect merely by naming it.
Our combined aggregate liability for all claims arising out of or relating to the Services or these Terms is limited to the greater of US $100 or the total subscription and usage fees you paid to Start Booking for the Services during the 12 months immediately preceding the first event giving rise to a claim. The cap is shared across related claims and proceedings, not renewed per claim, and excludes amounts you paid to Merchants for their offerings and third-party processor charges.
These exclusions and the cap apply regardless of legal theory, but do not limit liability for fraud, willful misconduct, gross negligence where limitation is unlawful, death or personal injury where limitation is unlawful, or any liability or statutory remedy that cannot lawfully be limited. Any mandatory statutory guarantees and remedies remain available. If a limitation is prohibited, it applies only to the maximum lawful extent.
11. Merchant indemnity
To the extent permitted by law, Merchants will defend and indemnify Start Booking and its personnel against third-party claims and resulting reasonable costs, damages and settlements arising from the Merchant’s unlawful offerings, infringing content, unlawful data or messaging practices, or material breach of these Terms. This does not cover loss caused by Start Booking’s own breach, negligence, willful misconduct or other responsibility that cannot lawfully be shifted. Booking Customers acting as consumers do not undertake this business indemnity.
We will promptly notify you, reasonably cooperate at your expense, and allow you to control the defense with competent counsel. Delay in notice relieves obligations only to the extent of material prejudice. No settlement may admit our fault, impose a nonmonetary obligation on us or leave a claim against us without our prior written consent, not unreasonably withheld. We may participate with separate counsel at our expense unless a genuine conflict requires otherwise.
12. Individual dispute resolution
Mutual agreement. Except as set out below, you and Start Booking agree to resolve disputes arising out of or relating to these Terms or the Services through binding individual arbitration instead of a court trial. This applies reciprocally to both parties, including contract, tort and statutory claims. The Federal Arbitration Act governs this agreement’s interpretation and enforcement where applicable. Mandatory law prevails.
Informal notice. Before filing arbitration, either party must send a written dispute notice describing the facts, requested relief and contact details. Send yours to support@startbooking.com with subject “Legal dispute notice”; we will send ours to your account email or another appropriate contact you provide. The parties will try in good faith to resolve it for 30 days after receipt. A party may file earlier to preserve a claim from expiry or obtain permitted urgent relief. Applicable limitation periods are tolled during this process to the extent permitted by law. No personal appearance or settlement conference is a prerequisite.
Administrator, rules and filing. Arbitration will be administered by JAMS under its applicable Streamlined or Comprehensive Arbitration Rules, with the JAMS Consumer Minimum Standards applying where applicable. Rules and filing instructions are at jamsadr.com and JAMS Consumer Minimum Standards. Either party may initiate after the informal period by filing a demand with JAMS and serving the other party as the rules require. If JAMS cannot administer, the parties will seek a mutually acceptable administrator with equivalent consumer protections; absent agreement, a competent court may appoint one as permitted by law. No substitute may reduce mandatory consumer protections.
Fair process and costs. One neutral arbitrator will hear the matter. Consumer hearings will be reasonably accessible in or near the consumer’s home jurisdiction, or by remote or documents-only process if the consumer chooses and the applicable rules allow. There is no mandatory distant venue. We will pay arbitration costs required by applicable law and JAMS standards, including consumer costs beyond any consumer filing fee allowed by those standards. We will not impose a company-payment cap or require consumers to pay our fees as a condition of a hearing. Each party otherwise bears its own lawyers’ costs except where a statute, applicable rule or lawful award provides otherwise. The arbitrator may award the same individual relief and statutory remedies available in court and must issue a reasoned written award. Court review and award enforcement are available as provided by law.
Exceptions. Either party may bring an individual matter within the jurisdiction of small-claims court and keep it there. Either may seek temporary court relief necessary to prevent immediate irreparable harm while arbitration proceeds. You may contact regulators and exercise rights to public injunctive relief or other remedies that cannot lawfully be assigned exclusively to individual arbitration. Claims excluded by statute, including claims subject to a valid statutory election against arbitration, remain in court. A court decides formation, enforceability and scope of the arbitration agreement and class waiver; the arbitrator decides the merits of arbitrable claims.
Individual proceedings; jury waiver. To the extent lawful, neither party may pursue a claim in arbitration as a class, collective, consolidated or representative proceeding, and the arbitrator may grant relief only for an individual claim. No class arbitration is authorized. This does not waive public or representative remedies that mandatory law preserves. For claims properly subject to arbitration, both parties waive a jury trial. Where a dispute lawfully stays in court, any jury waiver applies only to the extent separately valid under applicable law.
30-day opt-out. You may reject this arbitration agreement and its class/jury waivers by emailing support@startbooking.com with subject “Arbitration opt-out” within 30 days after first accepting this version’s arbitration agreement. Include your name and account email, if any, and a clear request to opt out. No fee, postal letter or reason is required. Your decision will not reduce access to the Services; neither party will then be bound by this section’s arbitration or class/jury waivers. Any previously applicable dispute agreement remains subject to its own terms and mandatory law. Keep a copy of your request.
Severability and survival. If the class waiver cannot be enforced for a particular claim or remedy, that claim or remedy proceeds in court, not class arbitration. Any remaining enforceable individual claims may proceed in arbitration unless mandatory law requires otherwise. Invalid provisions are severed only to the extent necessary without reducing required protections. This section survives account closure. We will not apply a later amendment to an accrued or already notified dispute without a valid separate agreement.
13. General terms and contact
Subject to mandatory local law and the Federal Arbitration Act, Utah law governs these Terms without its conflict-of-laws rules. For matters properly proceeding in court, the parties agree to the jurisdiction and venue of courts with jurisdiction in Utah County, Utah, or the federal District of Utah, except that a consumer may use any venue mandatory law permits. This contractual choice does not state where Liaison, Inc. was formed. It does not restrict section 12’s accessible-hearing requirements or any non-waivable right.
Neither party is responsible for delay caused by events beyond reasonable control, including natural disasters, war, government restrictions and widespread infrastructure failures, but this does not excuse accrued payment, reasonable mitigation, or non-waivable duties. A prolonged failure remains subject to mandatory termination and refund rights.
If a provision is unenforceable, the rest remains effective subject to section 12 and mandatory law. Failure to enforce a right is not a waiver. You may not assign the agreement without our consent, not unreasonably withheld; we may assign it in a reorganization or transfer of the Services subject to mandatory law and without reducing accrued rights. These Terms and applicable orders constitute the service agreement, without overriding separately agreed data-protection obligations. No third party receives enforcement rights except where law requires.
